The Planning and Building Services Department received an application for a Zoning By- law Amendment for lands located at 1956 Third Street. The Application was declared complete on Jan. 20, 2023, pursuant to section 34 (10.4) of the Planning Act, based on the information submitted with the application and a preliminary review by staff.
The application proposes a four-storey (13.8 metres), 256-bed Long-Term Care Facility with 130 surface parking spaces. The enclosed plan provides a conceptual site layout of the proposed development.
The City’s Zoning By-law currently zones these lands Business Commercial Employment with special provision 5 (E1-5). Special provision 5 restricts primary uses, increases accessory uses, and outlines several zoning requirements for the area known as the Westgate Business Park. A Long-Term Care Facility is not currently permitted on the subject lands.
The proposed zoning by-law amendment will address two issues:
1. Holding Provision
A holding provision is proposed to be placed on the subject land. The holding provision will only be removed once a functional servicing report is submitted to the City’s satisfaction and the completion of any off-site servicing works required for the proposed Long-Term Care Facility.
2. Special Provision
The applicant proposes to change the zoning by-law to add a Long-Term Care Facility as a permitted use on the subject lands. The proposal also seeks to reduce the required setback for the building from Pathstone Way as described below:

City Council is hosting a Legislated Public Meeting on Mar. 6, 2023, to receive input and comment on the proposed Zoning By-law Amendment, after which Council will consider staff’s recommendation on the amendment.
