Proposal
The Planning and Building Services Department received an application for Zoning By-law Amendment for lands located at 2000 Pathstone Way. The Application was declared complete on March 5, 2025, pursuant to Section 34 (10.4) of the Planning Act.
The applicant is seeking approval to construct two mixed use buildings ranging from 23.5m (6 storeys) to 51 m (15 storeys) in height containing a total of 313 apartment units and 2,121 square metres of commercial Gross Floor Area (GFA) at grade. The proposed development includes 122 surface parking spaces and one level of underground parking containing 219 spaces. A parkland block measuring 1,418 square metres in size is proposed to be conveyed to the City for future parkland contributions. The enclosed plan provides a conceptual site layout of the proposed development.
The City’s Zoning By-law currently zones these lands Business Commercial Employment with Special Provision 5 (E1-5). Special Provision 5 restricts principal uses and outlines several zoning requirements for the area known as the Westgate Business Professional Park. Residential dwelling units are not currently permitted on the subject lands.
The applicant is proposing to rezone the subject lands from Business Commercial Employment (E1) to High Density Mixed Use (M3) and replacing Special Provision five with a new Special Provision that establishes site-specific provisions for a number of items including minimum building setbacks, minimum platform structure setbacks, maximum building height, minimum parking requirements per dwelling unit and minimum landscape buffers.

This is an initial opportunity for public input prior to a formal Legislative Public Meeting on the matter at which time City Council will consider a staff report, recommendation, and a decision. The formal Legislative Public Meeting will be held at a later date with notice of that meeting provided approximately thirty days prior.

Legal Notice
With Bill 185 receiving Royal Assent, only the registered owner of the land to which the by-law would apply, specified persons, and public bodies as defined in the Planning Act may appeal a decision of the municipality or by-law to the Ontario Land Tribunal.
If a person or public body would otherwise have an ability to appeal the decision of (reference to council and name of municipality, or name of planning board or approval authority, as the case may be) to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to (name of municipality or planning board) before the by-law is passed, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting, or make written submissions to (name of municipality or planning board) before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
