On, May 13, 2024, City Council passed Zoning By-law 2024-052. City Council also passed By-law 2024-051 on May 13, 2024, adopting Official Plan Amendment No.41 under section 17 (which enables revisions to Zoning By-law 2013-283 as amended by Zoning By-law 2024-052).
Public input has been received, considered and has informed the decision of Council.
Complete copies of both by-laws are available for inspection in the office of the City Clerk, City Hall, during regular office hours.
Any person or agency may appeal the by-laws to the Ontario Land Tribunal by filing a notice of appeal with the City Clerk of the Corporation of the City of St. Catharines. The notice of appeal must set out the reasons for the appeal, and the specific part(s) of the Zoning By-law or Official Plan Amendment being appealed. A separate notice of appeal must be filed for each by-law and must be accompanied by Ontario Land Tribunal fee of $1,100, by certified cheque or money order payable to the Minister of Finance. If you wish to appeal both by-laws the total required fee is $2,200. A copy of an appeal form is available from the Ontario Land Tribunal website at https://olt.gov.on.ca/appeals-process/forms/ .
Notice of appeal must be received by the City Clerk no later than June 12, 2024.
Only individuals, corporations or public bodies may appeal a decision of the approval authority to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
The proposed Official Plan amendment is exempt from approval by the Regional Municipality of Niagara. The decision of the council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.
