On June 10, 2024, City Council adopted Official Plan Amendment No. 42 and passed By-law 2024-072 under section 17 and 34 of the Planning Act.
The Official Plan and Zoning By-law amendments facilitate the development of a three-storey, twelve unit apartment building at 179 Ontario Street, retains an existing fourplex dwelling at 4 Welland Vale Road, and establishes a shared driveway and parking area to service both properties.
The purpose of Official Plan Amendment No. 42 is to redesignate 4 Welland Vale Road from Neighbourhood Residential (Schedule D1) and Low Density Residential (Schedule E4) to Mixed Use (Schedules D1 and E4) to facilitate the development. The Official Plan Amendment permits a standalone parking lot to serve the two properties and prohibits specific auto-related uses.
The purpose of By-law 2024-072 is to rezone the subject lands from Low Density Residential – Suburban Neighbourhood (R1), in part, and Medium Density Mixed Use (M1), in part, to Medium Density Mixed Use with a Special Provision (M1-176) to facilitate the development. The Special Provision permits a standalone parking lot to serve the two properties with a reduced drive aisle width, lot frontage, parking ratio for the apartment building, and landscape buffer along the western lot line. In addition, the Special Provision permits reduced lot area per dwelling unit for the apartment building, reduced setbacks for the apartment building and fourplex, and prohibits specific auto-related uses on the subject lands.
Community input has been received, considered and has informed the decision of Council.
Complete copies of Official Plan Amendment No. 42 and By-law 2024-072 are available for inspection in the office of the City Clerk, City Hall, during regular office hours.
The last day for filing a notice of appeal is July 11th, 2024. The notice of appeal must be filed with the Clerk, set out the specific objection to the by-law(s) and the reasons in support of the objection, and be accompanied by the fee required by the Ontario Land Tribunal (OLT). The proposed official plan amendment is exempt from approval by the Niagara Region. The decision of council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.
With Bill 185 receiving Royal Assent on June 6, 2024, only the registered owner of the land to which the by-law would apply, corporations and public bodies as defined in the Planning Act may appeal a decision of the municipality or by-law to the Ontario Land Tribunal.
No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
