TAKE NOTICE that the Council of the municipality of the City of St. Catharines passed Parkland Dedication By-law No. 2022-173 on the 26th day of September, 2022, under section 42 of the Planning Act, R.S.O. 1990, c. P.13, as amended;
AND TAKE NOTICE that any person or organization may appeal to the Ontario Land Tribunal under section 42 (4.9) of the Planning Act, in respect of the Parkland Dedication By-law, by filing with the Clerk of the municipality of the City of St. Catharines on or before the 7th day of November, 2022, a notice of appeal setting out the objection to the by-law and the reasons supporting the objection.
Parkland Dedication By-law
Parkland dedication is a tool under the Planning Act that allows municipalities to receive land or a cash payment in lieu of land as a condition of development or redevelopment. The City has used parkland dedication as a means to acquire land for parks purposes since 1974. To-date, parkland dedication has only been required as a condition of residential development or redevelopment. On the 1st of January, 2023, to help better fund growth-related parkland costs, the City will implement new and additional parkland dedication rates that apply to a broader range of land uses.
The new parkland dedication By-law applies to all lands located within the urban area of the Municipality of the City of St. Catharines, as outlined in the map above, and will impose the following rates on eligible developments:
Parkland dedication is calculated and collected prior to final approval of an application for site plan approval, consent to sever, plan of subdivision, or plan of condominium, for eligible development or redevelopment. With the exception of the per lot rate, payments in lieu of land are based on the appraised value of the land being developed.
