On Sept. 9, 2024, City Council passed By-law 2024-115, adopting an amendment to the City’s Parkland Dedication
By-law (By-law 2022-173) under Section 42 of the Planning Act. The By-law amends the City’s Parkland Dedication By-law to achieve conformity with the Planning Act, following changes to provincial legislation resulting from the More Homes Built Faster Act (Bill 23).
The amendment has the following effect on the amounts required for land dedication and payment in lieu of land dedication for residential development/redevelopment:
The amendment establishes land dedication for residential uses to be the greater amount of:
a) Five per cent (5%) of the land to be developed; or
b) A rate of one (1) hectare per 600 net residential units.
• But not more than:
a) 10% of any lands for development for land five hectares or less; or
b) 15% of any lands for development for land greater than five hectares
• A further reduction is applied to developments that include affordable or attainable units
The amendment establishes the following ratios for payment in lieu of land dedication for residential uses:
• One (1) hectare per 1,000 dwelling units
• But not more than:
a) 10% of any lands for development for land five hectares or less; or
b) 15% of any lands for development for land greater than five hectares
A complete copy of the by-law is available for inspection in the office of the City Clerk, City Hall, during regular office hours.
Any person or public body may appeal the by-law to the Ontario Land Tribunal, under subsection 42 (4.9) of the Planning Act, by filing a notice of appeal with the City Clerk of the Corporation of the City of St. Catharines. The notice of appeal must set out the objection to the by-law, the reasons supporting the objection and must be accompanied by Ontario Land Tribunal fee of $1,100, by certified cheque or money order payable to the Minister of Finance. A copy of an appeal form is available from the Ontario Land Tribunal website at https://olt.gov.on.ca/appeals-process/forms/.
Notice of appeal must be received by the City Clerk no later than Oct. 19, 2024.
Given that the subject amendment affects the City’s Parkland Dedication By-law, which applies to all lands located within the Urban Area of the City of St. Catharines, a key map has not been provided with this notice.
